General Terms and Conditions
1. Scope of application
These General Terms and Conditions apply to all orders placed by customers resident in Switzerland or the Principality of Liechtenstein via the online shop www.beauty-essentials.ch of the company Zürcher Cosmetics GmbH, Schüepwisstrasse 1A, 8117 Fällanden, UID CHE115. 122.090, hereinafter referred to as Zürcher Cosmetics GmbH.
2. Offer and conclusion of contract
2.1. The presentation of the products on www.beauty-essentials.ch does not constitute a legally binding offer, but an invitation to the customer to place a binding order (offer to conclude a contract).
2.2. By clicking on the order button "SEND ORDER NOW", the customer places a binding order for the products listed on the order page.
2.3. Immediately after receipt of the order, Zürcher Cosmetics GmbH shall confirm receipt of the order by email. The purchase contract shall only be concluded when Zürcher Cosmetics GmbH confirms the dispatch of the goods by email (order or dispatch confirmation), or at the latest by delivery of the goods.
2.4. In the case of payment by pre-payment, the purchase contract is concluded with confirmation of receipt of the pre-payment by Zürcher Cosmetics GmbH.
3. Right of return
3.1. Customers have the right to return the goods during 14 days after delivery of the goods. The right of return is exercised by returning the goods, no justification is required. The return must be sent to Zürcher Cosmetics GmbH, Einkaufszentrum Glatt, Neue Winterthurerstrasse 99, 8304 Wallisellen.
3.2. The goods must be returned in their original packaging, undamaged, unused and in an unopened condition.
3.3. The exercise of the right of return leads to the conversion of the purchase contract into a rescission relationship, according to which the services received under the purchase contract must be refunded. The costs of the return shipment shall be borne by the consumer.
3.4. After receipt of the goods, any purchase price already paid will be refunded to the customer without delay.
3.5. A deduction from the purchase price to be refunded, or an invoice for possible damage, excessive wear and tear of the goods or, if agreed, costs of sending the goods to us, is reserved. No deduction shall be made if the loss in value is due to handling of the goods that is necessary to establish the nature, condition and functionality of the goods. Zürcher Cosmetics GmbH can refuse repayment until it has received the goods back.
4. Prices and shipping costs
4.1. The prices stated in the online shop include the statutory value-added tax and other price components and are in Swiss francs (CHF).
4.2. In addition to the stated prices, shipping costs may be incurred depending on the delivery address, quantity of goods and item. The exact shipping costs are displayed to the customer in the order process. No further costs are incurred for delivery within Switzerland.
5. Promo vouchers
5.1. Promo vouchers cannot be purchased. Within the scope of advertising campaigns, Zürcher Cosmetics GmbH issues promo vouchers which have a limited period of validity.
5.2. Promo vouchers are only redeemable during the specified period, and only once as part of an order process. It is possible that individual brand products are excluded from the Promo. It is not possible to use Promo Vouchers for the purchase of gift vouchers. In addition, it is possible that a Promo Voucher is tied to a minimum order value.
5.3. If the value of the goods is higher than the promo voucher, the difference can be paid using the payment methods offered.
5.4. The value of the Promo Voucher cannot be paid out and does not accrue interest.
5.5. The promo voucher can no longer be used after the order has been completed.
5.6. Only one Promo Voucher can be used per purchase. A cumulation of several Promo Vouchers is not possible.
5.7. The value of the Promo Voucher will not be refunded if the goods are returned in whole or in part.
6. Minimum order value
The minimum order value is CHF 50.00 incl. VAT per order, and corresponds to the total of the shopping basket without postage costs.
7. Delivery conditions
7.1. Delivery shall only be made to delivery addresses within Switzerland and the Principality of Liechtenstein.
7.2. The availability/delivery times stated in the online shop are updated continuously. Delays may occur due to delivery bottlenecks on the part of suppliers or Zürcher Cosmetics GmbH. All information on availability is without guarantee and may change at any time.
7.3. The standard delivery time is 1 - 4 working days, unless otherwise stated in the offer.
7.4. If not all ordered products are in stock, Zürcher Cosmetics GmbH is entitled to make partial deliveries. The customer shall not incur any additional costs due to partial deliveries.
7.5. Should the delivery of the goods fail through the fault of the customer despite three attempts at delivery, Zürcher Cosmetics GmbH may withdraw from the contract. Any payments made shall be refunded.
8. Terms of payment
8.1. Payment is made by invoice (only after a successful credit check), credit card, TWINT,PayPal or cash in advance. For each order, we reserve the right not to offer certain payment methods and to refer to other payment methods.
8.2. If the payment method pre-payment is selected, Zürcher Cosmetics GmbH shall inform the customer of its bank details. The invoice amount is to be transferred to the account of Zürcher Cosmetics GmbH within 5 days.
8.3. If payment is made by credit card, the customer's account will not be debited until the goods have been dispatched, unless otherwise agreed. A reservation of the order value is made at the time of the order.
8.4. If payment is made by TWINT or PayPal, the customer's account will be debited upon dispatch. Exceptions are orders with products that are not in stock. In this case, the debit will be made no later than 5 days after receipt of the order.
8.5. Offsetting with counterclaims of the customer that are not recognised or not legally established is excluded.
8.6. The customer may only exercise a right of retention insofar as the claims are based on the same contractual relationship.
9. Late payment / payment reminder / reminder / debt collection
9.1. In the case of delivery on account, the purchase price shall be due within 30 days of dispatch of the goods. If payment is not made within this period, the customer shall be in default.
9.2. In the event of default, Zürcher Cosmetics GmbH shall remind the customer after 15 days by e-mail and/or letter.
9.3. In the event of default, Zürcher Cosmetics GmbH shall send the customer 2 reminders in writing. The following fees are due with the reminder of the claim:
1st reminder after 30 days reminder charges 20.00 CHF
2nd reminder (final reminder) after 50 days reminder fees 20.00 CHF
In addition to the reminder fees, interest on arrears will be charged at a rate of 5% from the due date of the claim. If the outstanding amount is still not paid after the last reminder, the claim will be pursued. Zürcher Cosmetics GmbH will hand over the claim to the company Intrum AG for collection. Costs in the event of late payment: processing fee (at the earliest from day 70 after the invoice date, when handed over to collection service provider) depending on the amount of the claim, maximum amount in CHF: 50 (up to 20); 70 (up to 50); 100 (up to 100); 120 (up to 150); 149 (up to 250); 195 (up to 500); 308 (up to 1,500); 448 (up to 3,000); 1,100 (up to 10,000); 1,510 (up to 20,000); 2,658 (up to 50,000); 6% of the claim (from 50,000).
10. Retention of title
The goods shall remain the property of Zürcher Cosmetics GmbH until payment has been made in full. Before transfer of ownership, pledging, transfer by way of security, processing (what does this mean?) or transformation (what does this mean?) is not permitted without the consent of Zürcher Cosmetics GmbH.
11. Warranty
11.1. Zürcher Cosmetics GmbH provides a warranty by rectifying defects. This shall be done at its discretion by means of subsequent performance, namely the elimination of a defect (rectification) or the delivery of a defect-free item (replacement).
11.2. If the supplementary performance fails, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. A right of the customer to a reduction is excluded.
12. Liability
Zürcher Cosmetics GmbH excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes.
13. Data protection
Zürcher Cosmetics GmbH undertakes to comply with the data protection regulations when processing customer data. Further information on the handling of customer data can be found on the separate Privacy Policy of Zürcher Cosmetics GmbH. 14. Code of conduct for product reviews, blog and news comments
To ensure that we can publish your review, blog or news comment on our pages, you should note the following:
- The review must be written in German, French, Italian or English
- Must not contain any swear words, obscene, fascist, racist, anti-Semitic or similar expressions
- Must not contain any personal data with telephone numbers, email addresses, URL's
- Must not contain any references to other sources of supply
- Must not contain any comments that do not relate to the product or the blog/news
We are of course happy to receive suggestions and criticism of our service. Please send them to info@beauty-essentials.ch.
We cannot publish reviews, blog and news comments that do not comply with these guidelines. Furthermore, please note that reviews, blog or news comments will only be released after they have been reviewed. Product reviews are only possible for registered customers who have also purchased this product from us. Blog or news comments are only possible for registered customers.
By providing us with your review, you grant Zürcher Cosmetics GmbH, free of charge, the exclusive right, unlimited in time and place, to use your review by disseminating it on the Internet or in other media. There is no entitlement to publication of the rating, blog or news comments and your personal authorship.
15. Final provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
